Tabvana Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Tabvana Chrome extension ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Tabvana is a Chrome extension provided by Util Studios, a sole proprietorship business based in the United States. The Service provides AI-powered browser tab organization and summarization, helping users manage large numbers of open tabs through intelligent categorization and content summarization.

2.1 Core Features

• AI-powered tab categorization and organization
• Tab content summarization
• Real-time tab processing and streaming results
• Tab management and closing functionality

3. Account Registration and Authentication

3.1 Google Account Requirement

To use Tabvana, you must have a Google account and be signed into Chrome. The Service uses Chrome's identity API for authentication.

3.2 Account Responsibility

• You are responsible for maintaining the security of your Google account
• You must provide accurate information during the sign-up process
• You are responsible for all activities that occur under your account

4. Subscription and Billing

4.2 Subscription Terms

• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Billing Date: You will be charged on the same day each month
• Price Changes: We will notify you 30 days before any price changes
• Currency: All prices are in USD unless otherwise stated

4.3 Service Pricing

• Subscription Required: A paid subscription is required to use Tabvana
• Monthly Subscription: $4.99 per month for 1,000 tabs per month, plus priority support
• Usage Limits: When monthly limits are reached, processing is restricted until the next billing cycle
• Billing Cycle: Usage counters reset on your monthly billing date

5. Cancellation and Refunds

5.1 Cancellation

• You may cancel your subscription at any time through the Stripe customer portal
• Cancellation takes effect at the end of your current billing period
• You will retain access to premium features until the end of your paid period

5.2 Refund Policy

• Pro-rated Refunds: Generally not provided for partial months
• Technical Issues: Refunds may be provided for service outages lasting more than 24 hours
• Disputed Charges: Contact us immediately for resolution
• Refund Requests: Must be made within 30 days of the charge

6. Acceptable Use

6.1 Permitted Use

You may use Tabvana for personal and commercial tab organization purposes in accordance with these Terms.

6.2 Prohibited Activities

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or modify the extension
• Use automated scripts or bots to interact with the Service
• Share your account credentials with others
• Violate any applicable laws or regulations
• Process tabs containing illegal, harmful, or inappropriate content
• Overload or attempt to disable our servers or infrastructure

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

7.1 Data Processing

• Tab data is processed temporarily for AI analysis
• No personal browsing data is permanently stored
• All data transmission is encrypted

8. Intellectual Property

9. Service Availability and Limitations

• We strive for 99% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• Service may be temporarily unavailable due to technical issues

9.2 Usage Limits

• Fair usage policies apply to prevent abuse
• Excessive usage may result in temporary rate limiting
• Commercial usage exceeding 10,000 tabs per month may require enterprise pricing

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 AI Processing Disclaimer

• AI-generated summaries and categorizations may contain inaccuracies
• We are not responsible for decisions made based on AI-generated content
• Users should verify important information independently

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TABVANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS.

11. Indemnification

You agree to indemnify and hold harmless Tabvana from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

You may terminate your account at any time by cancelling your subscription and uninstalling the extension.

• Locally stored data may be retained until extension removal
• No refunds will be provided for early termination due to violations

13. Updates and Modifications

We may update the Service from time to time to add new features, fix bugs, or improve performance. Updates are delivered through the Chrome Web Store.

13.2 Terms Updates

We may modify these Terms at any time. Material changes will be communicated through the extension or email. Continued use constitutes acceptance of updated Terms.

15. Governing Law and Dispute Resolution

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tabvana regarding the Service.

These terms are designed to comply with Chrome Web Store requirements and applicable consumer protection laws.
